1. Agreement to Terms

By accessing or using Searchbird ("the Service"), operated by Skelpo GmbH ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Searchbird is a Google Search Console aggregator that allows users to view data from multiple Google Search Console properties in a single dashboard. The Service accesses your Google Search Console data through the Google API with read-only permissions.

3. Account Registration

To use Searchbird, you must sign in with a Google account. By signing in, you:

  • Authorize us to access your Google Search Console data (read-only)
  • Confirm that you have the right to access the Search Console properties in your account
  • Agree to provide accurate account information
  • Are responsible for maintaining the security of your account

4. Free and Paid Plans

4.1 Free Plan

The free plan allows access to up to 3 Google Search Console properties with all features included.

4.2 Paid Plans

Paid plans offer access to more properties. Pricing is as displayed on our website at the time of purchase.

4.3 Billing

  • Paid subscriptions are billed monthly or annually in advance
  • All fees are exclusive of applicable taxes
  • Prices may change with 30 days notice

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. We offer a 14-day free trial on paid plans. No refunds are provided for partial months or unused time after the trial period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract the source code
  • Use automated systems to access the Service beyond normal use
  • Resell or redistribute the Service without authorization
  • Use the Service to access Search Console properties you do not own or have permission to access

6. Intellectual Property

The Service, including its design, features, and content (excluding your data), is owned by Skelpo GmbH and protected by intellectual property laws. You retain all rights to your data.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We only access your Google Search Console data with read-only permissions and do not modify any data in your Google account.

8. Third-Party Services

The Service integrates with Google Search Console via the Google API. Your use of Google services is subject to Google's terms of service. We are not responsible for the availability or accuracy of data provided by Google.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. Data freshness depends on Google Search Console API availability.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF DATA DISPLAYED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKELPO GMBH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Skelpo GmbH from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us.

14. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hagen, Germany.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
